Terms & Conditions

These Terms & Conditions ("Terms") govern your use of this website and the services provided by Yurany Vargas ("we", "us", or "our"). By using our site or opting in to our messaging, you agree to these Terms.

1. Services

Yurany Vargas provides beauty and skin care services — including permanent makeup, laser treatments, and facials — and related appointment scheduling and communications in San José, California.

2. SMS/Text Messaging Terms

By providing your mobile number and checking a consent box on our form, you agree to receive SMS text messages from Yurany Vargas.

• Program description: booking, appointment, and follow-up messages related to your inquiries and bookings with Yurany Vargas. Promotional messages are a separate, optional opt-in.
• Message frequency: varies based on your appointments and interactions with us.
• Cost: Message and data rates may apply for messages sent to you from us and to us from you.
• Opt-out: you can cancel at any time. Simply reply STOP. After you send "STOP", we will confirm and stop sending SMS messages. You can opt back in at any time as before.

• Carriers: carriers are not liable for delayed or undelivered messages.
• Consent: your consent to receive SMS messages is not a condition of any purchase or service.

3. Privacy

Your use of our services is also governed by our Privacy Policy. We do not share your mobile information or SMS opt-in/consent data with third parties for marketing purposes.

4. Appointments, Deposits & Cancellations

Appointments are confirmed with a deposit, which is applied to the final price of the service.

• The deposit is non-refundable. It may be transferred once to a rescheduled appointment when you give us at least 48 hours' notice.
• Cancelling or rescheduling with less than 48 hours' notice, or not attending your appointment, forfeits the deposit.
• Arriving more than 15 minutes late may mean your appointment has to be shortened or rescheduled, as later clients are waiting.

5. Results & Expectations

Cosmetic results vary from person to person. Permanent makeup is a semi-permanent treatment: pigment heals, softens and fades differently depending on your skin type, undertone, aftercare, sun exposure, medication and lifestyle. Most permanent makeup work requires more than one session to reach its final result. Laser results likewise depend on skin and hair type, the area treated and the number of sessions completed. Yurany Vargas does not guarantee any specific outcome, shade, number of sessions or duration of results.

6. Health, Suitability & Right to Refuse

Before any treatment you must disclose, accurately and completely, any medical condition, medication, allergy, skin condition, recent cosmetic or medical treatment, and whether you are pregnant or breastfeeding. Some conditions and medications make a treatment unsafe or unsuitable.

A patch test may be required before certain treatments. Yurany Vargas may decline, postpone or stop a treatment at any time if it is judged unsafe or unsuitable for you, or if information you provided was incomplete or inaccurate. You are responsible for following any pre-treatment instructions you are given.

7. Aftercare & Touch-Ups

Your result depends heavily on following the aftercare instructions you receive. Any complimentary touch-up offered is conditional on those instructions having been followed. Corrections needed because aftercare was not followed, or because of picking, sun exposure, or treatments performed elsewhere, are charged as new work.

8. Not Medical Advice

Yurany Vargas provides cosmetic beauty services. Nothing on this site or said during a consultation is medical advice, diagnosis or treatment, and no doctor-patient relationship is created. If you have a health concern, consult a licensed physician.

9. Photography & Client Images

We may photograph or film work before, during and after treatment for our records, portfolio and social media. If you prefer that your images are not published, tell us in writing before your appointment and we will not publish them.

10. Age Requirement (18+)

You must be at least 18 years of age to receive services from Yurany Vargas and to opt in to our SMS program. By using our site, booking an appointment, or opting in to messaging, you confirm that you are 18 or older.

11. Acceptable Use

You agree to provide accurate information and to use our site and services lawfully.

12. Limitation of Liability

To the maximum extent permitted by law, Yurany Vargas is not liable for any indirect, incidental or consequential damages arising from your use of this site or of our services, including any dissatisfaction with a cosmetic result, any reaction arising from information you did not disclose, or any outcome affected by aftercare you did not follow. Where liability cannot lawfully be excluded, it is limited to the amount you paid for the service in question.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under California law.

13. Governing Law

These Terms are governed by the laws of the State of California. Any dispute will be brought in the state or federal courts located in Santa Clara County, California.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of our site or services after changes means you accept the updated Terms.
